Als je wilt reageren op een Scope of op een gebruikersprofiel, dan kun je het contactformulier invullen, welke direct naar de scope eigenaar wordt gestuurd. Als je zelf Scopes wilt aanmaken dien je jezelf te registreren (gratis). Registreren is heel eenvoudig, wij vragen een geldig email adres, daarnaast vul jij je gebruikersnaam in met een persoonlijk wachtwoord. Hier kun je aangeven of je een bedrijf of particulier bent. Dit kun je altijd later nog wijzigen. Een gebruikersnaam kan jouw echte naam zijn maar ook een verzonnen naam. Maak een wachtwoord niet te eenvoudig anders is deze misschien te ‘hacken’. Ben jij je wachtwoord vergeten of wil jij deze wijzigen? Ga naar de pagina ‘aanmelden’ en click op; wachtwoord wijzigen. Profielen Ben je geregistreerd dan kun je jouw profiel aanmaken. Je bepaalt zelf welke gegevens zichtbaar zijn. Vul zoveel mogelijk alles in, dit is van belang indien je goed gevonden wilt worden. De trefwoorden in je profiel zijn niet zichtbaar, alleen voor de zoekmachines. Je kunt in de omschrijving ook hyperlinks plaatsen en afbeeldingen (html) insluiten. Zorg altijd dat je een Avatar(afbeelding of logo) hebt, de ervaring leert dat er meer geklikt wordt op volledig ingevulde profielen. Je kunt volstaan met uitsluitend je profiel te plaatsen in i-Scope, hierdoor wordt je gevonden in i-Scope en ook beter in andere zoekmachines. Wij adviseren je echter om presentaties en webshops, te gaan maken. Een scope is een extra website, dit zorgt voor veel meer bezoekers, zoekmachines waarderen dit en geven hiervoor een hogere ranking. Daarnaast voorkom je dat op jouw homepagina in i-Scope een titel scope wordt afgebeeld die niet van jou is. Dit kun je alleen voorkomen als je zelf een Scope hebt aangemaakt. Scopes, Webshops en Scopegroepen Je kunt gratis meerdere Scopes, Webshops en Scopegroepen plaatsen. Een Scope is een dynamische presentatie van gecombineerde multimedia bestanden. Het visuele -foto’s en video’s; Audio - geluidsopname en muziek; Teksten - bij elke bestand en als tekstpagina’s. Er worden geen limieten aan het aantal bestanden per Scope gesteld. Scopes maken Iedereen kan Scopes maken en deze in groepen plaatsen. Via een gemakkelijk en eenvoudige stappenplan kun je foto’s -, video’s -, en audiobestanden opslaan. Per bestand kun je een titel en een bijschrift plaatsen. Bepaal welk bestand gezien wordt in de resultatenlijst (voorvertoon). Elke Scope krijgt een titel. Je scope kun je ook linken aan een andere website of webpagina. In de scope omschrijvingen kun je teksten, hyperlinks en afbeeldingen (html) plaatsen. Bepaal de geografische ligging via Maps. Je kunt jouw Scope een eigen i-Scope domeinnaam meegeven. Dit domein begint altijd met i.scope.com/scope/………………… hier kun je zelf een naam invullen. Hierdoor is elke Scope een mini-website, met alle kenmerken van een website. Belangrijk is om jouw Scope een aantal relevante trefwoorden mee te geven. Hierop wordt binnen i-Scope en andere zoekmachines gezocht. Elke Scope heeft zijn eigen kenmerk, is privé, wordt met vrienden gedeeld (groep) of is openbaar. Aan welke belangrijke eisen moet een goede Scope voldoen om optimaal gevonden te worden? 1) Dynamische multimedia bestanden met goede kwaliteit. Minimaal 5 bestanden. 2) Elk bestand voorzien van een titel en een omschrijving 3) Titel van de Scope. 4) Omschrijving van de Scope. Met hyperlinks! 5) Trefwoorden optimaal 8 stuks. 6) Regelmatig je presentatie aanpassen. 7) Scope doorsturen aan vrienden en relaties. 8) Scope inbouwen in andere websites. In de resultatenlijst worden de Scopes met de laatste wijzigingen bovenaan geplaatst! Dus actieve gebruikers worden beloond. Webshops Een webshop maken is feitelijk net zo eenvoudig als een scope presentatie. Je gaat eerst naar je homepagina en click op My Shop. Je kunt nu in het menu ‘Artikel’ kiezen. Vul hier de artikelen in die je wilt gaan verkopen in je webshop. Je kunt deze lijst zo uitgebreid maken als je zelf wilt, de artikelen zijn eenvoudig te wijzigen. Wil je bedrijfsmatig een webshop maken vul dan het bedrag excl. Btw in en bepaal tot welk btw tarief (in procenten) het artikel behoord. Als particulier kun je het btw tarief op o% zetten. Voordat je een webshop kan aanmaken, dien je eerst de volledige bankgegevens in te vullen, waarop i-Scope de ontvangen bedragen kan overmaken. Nu kun je een scope aanmaken, waarbij je artikelen kunt linken aan een afbeelding, video of audiobestand. Je webshop is klaar. Indien je graag met Resellers wilt gaan werken kun je dit stimuleren door een hogere provisie percentage in te vullen. 5% is het standaard percentage, wat Resellers ontvangen. Heb je meerdere shops, dan plaats je deze shops in een groep. Deze complete winkel kun je ook weer inbouwen (embedden) in andere websites en sociale media. Bij de webshop zit een betaalmodule, administratie- en ordersysteem geïntegreerd. Daarnaast kun je zien of je Webshop door Resellers is ingebouwd en wat hun verkoopresultaten zijn. Dagelijks worden opdrachten aan je doorgegeven en de betalingen worden door i-Scope gezekerd. Indien de zending klaar is voor transport kun je de transportgegevens invullen en wordt de betaling direct aan je overgemaakt. Deze betaling is minus 2% i-Scope provisie en (eventueel minus 5% Resellers provisie) + de kosten van de betaling (ice pay). I-Scope adviseert Scope Groepen Je kunt al je Scopes en webshops in een Scopegroep plaatsen. Bepaal of deze Scopegroep privé is of kan worden bekeken door je vrienden of door iedereen. Bij een Scopegroep kun je een logo plaatsen en een groeptekst. Daarnaast kun je voor de gehele groep trefwoorden aanmaken. Bij een Scopegroep kan een bezoeker notities maken. In elke groep kun je binnen de groep zoeken op trefwoorden. Elke groep heeft weer een uniek URL die de groepeigenaar zelf kan bepalen. Je kunt je eigen scopes en je favorieten scopes in een groep plaatsen. Een groep kun je ook ‘embedden’ in ander websites of sociale media. Er worden geen limieten aan het aantal Scopes in een groep gesteld! Resellers Producten of diensten bestellen vanuit je eigen winkel? Dit is mogelijk bij i-Scope, maakt vandaag nog een groep van je favoriete webshops en plaats deze groep in eigen website, andere websites en sociale media! Iedereen kan Reseller worden er zijn geen restricties! Plaats je favoriete webshop in je sociale media en koop al je producten direct vanuit je eigen winkel en ontvang zo hoge kortingen! Daarnaast kunnen al jouw vrienden ook in jouw online winkel gaan shoppen en kun jij extra inkomen genereren. Als Reseller ontvang je minimaal 5% provisie. In ons platform kun je binnen 1 stap de resultatenlijst zien. Type 1 of meerdere trefwoorden in het zoekvenster (wie, wat of waar) en je ziet een resultatenlijst. Profielen zijn blauw, Scopes en webshops worden met een enkele afbeelding weergegeven in het grijs en Scopegroepen met meerdere afbeeldingen en in een geel kader. Klik op de afbeelding en je kunt de gewenste presentatie bekijken. Je kunt ook uitsluitend in Scopes, profielen of groepen zoeken. Premium Accounts Gratis service I-Scope is een platform welke toegankelijk is voor iedereen. Je hoeft geen abonnement af te sluiten en je kunt GRATIS gebruik maken van i-Scope. De service die wij bieden heeft geen datalimieten. Bij een GRATIS account, zowel voor bedrijven als voor particulieren, zullen wij in elke Scope een reclameboodschap plaatsen. Indien je alleen een account aanmaakt, plaatsen wij een titel Scope op jouw startpagina, deze kun je zelf aanpassen, echter uitsluitend als je één of meerdere Scopes hebt. In een titel Scope worden advertenties gepresenteerd. Abonnement Indien je geen reclames in je Scopes wilt zien, dan kun je dit afkopen. Het bedrag is afhankelijk van het aantal Scopes die jij zonder reclame wilt presenteren en is een jaarlijkse bijdrage. Ga naar wijzig in je profiel en bepaal jouw abonnementsvorm. Vervolgens kom je in het betalingsmenu. Na de betaling kun je een aantal van jouw scopes markeren, waarin wij GEEN reclame mogen vertonen. Je gebruikt i-Scope als je Control Management Systeem. Consumenten i-Scope biedt consumenten en bedrijven meer zekerheid dat hun bestellingen ook daadwerkelijk worden geleverd. Restitutie van gelden worden tussen Webshop-eigenaar en de consument rechtstreeks afgehandeld Indien de consument zijn betaalde goederen niet binnen 120 kan traceren, zullen wij de webshop eigenaar verwittigen dat deze binnen 3 werkdagen alsnog de goederen dient te versturen, anders zal de koopovereenkomst worden ontbonden. I-Scope zal de consument zijn betaalde bedrag terugstorten -/- 5% administratie fee. Spelregels Ieder bedrijf heeft zijn eigen spelregels of voorwaarden, ook i-Scope stelt een aantal voorwaarden aan haar gebruikers om de site te behoeden voor oneigenlijk gebruik. I-Scope is een vrij medium en hoopt stellig dat haar gebruikers de site gebruiken zoals deze is bedoeld. Geen onethische afbeeldingen op het gebied van uiterlijk, ras, religie, cultuur, seks en geslacht. Geen content die oproepen tot geweld , uitbuiting, of misbruik van personen of groepen. Geen illegale uploads waarvan de eigenaar uitdrukkelijk publicaties heeft verboden. Geen afbeelding van personen die hiervoor geen toestemming hebben verleend. Geen plagiaat of nabootsing van auteursrechtelijk beschermde afbeeldingen. Geen vulgaire of discriminerende teksten inzake uiterlijk, ras, religie, cultuur, seks en geslacht bij de Scope commentaren. Let op: Scopes die niet correct zijn kunnen worden gerapporteerd en vervolgens worden verwijderd van openbare- naar privé toegankelijkheid. Ook vulgaire commentaar bij een Scope kan snel worden verwijderd door de Scope eigenaar en heeft dus geen enkele toegevoegde waarde. Webmedia- en reclamebedrijven Professionals kunnen veel meer met i-Scope doen dan een ‘gewone’ gebruiker. Maak extra business, om al uw klanten naast een website ook een Scope aan te bieden. Algemene Leveringsvoorwaarden de Website: de website www.i-Scope.com, die wordt geëxploiteerd door HomeatWorld BV (hierna te noemen H@W), De Steiger 206D, 1351 AW Almere, Nederland, KVK nummer 39098993 identificatienummer NL817939660 Artikel 1. Definities. 1.01 Scope: een set van files (foto’s, video’s, muziek en teksten) 1.02 SponsorScope:een op de Website geplaatste Scope, die tegen betaling is verbonden met een bepaalde posities op een andere pagina. 1.03 TopScope: een op de Website geplaatste Scope, die tegen betaling is verbonden met een positie op de startpagina. 1.04 TitelScope: een Scope, die op de home pagina van de gebruiker wordt geplaatst. 1.05 Banner: een tegen betaling op de Website geplaatste reclame banner. 1.06 Adverteerder: degene die een betaalde banner, gelinkte scope of een reclame in een Scope plaatst op de Website; 1.07 Gebruiker: degene die, anders dan als Adverteerder en abonnee, onbetaald gebruik maakt van de Website; 1.08 Abonnee: degene die, anders dan als gebruiker, betaald gebruik maakt van de Website; 1.09 Klant: kan Adverteerder, gebruiker of abonnee zijn 1.10 Bezoeker: degene die uit interesse, nieuwsgierigheid of informatief de Website bezoekt. 1.11 Overeenkomst: enige overeenkomst tussen H@W en Klanten die voortvloeit uit het gebruik van de Website; 1.12 Persoonsgegevens: de door bedrijven of particulieren verstrekte gegevens die tot zijn of haar persoon herleidbaar zijn, waaronder naam/adres/woonplaats en e-mailadres. 1.13 Data: Alle opgeslagen bestanden, in MB (megabytes) weergegeven. 1.14 Credits: Rekeneenheid om Advertenties die worden geplaatst af te rekenen in bedragen t.o.v. het aantal ingeplaatste scopes. 1 credit = 1 dag plaatsing per 1 scope. 1.15 WebShop: Webshop bestaande uit 1 of meerdere Scopes, waarin een bestel- en betalingsmoduleisopgenomen. 1.16Scopegroep: Scopes of webshops die in een groep zijn opgenomen. 1.17 Seller: Bedrijven of personen die een 1 of meerdere webshops hebben aangemaakt. 1.18 Reseller: Bedrijven of personen die een webshop van derden in ander websites of sociale media hebben geplaatst. 1.19 Provisie: Een percentage van de omzet. 1.20 Embedden: Inbouwen of exporteren van de i-Scope flash spelers in andere websites of sociale media. Artikel 2. Toepasselijkheid. 2.1 Deze algemene voorwaarden zijn van toepassing op de relatie tussen klanten enerzijds en H@W anderzijds. 2.2 De toepasselijkheid van andere algemene voorwaarden dan de onderhavige is uitgesloten. Artikel 3. Plaatsing van Scopes en Banners. 3.1 Door het plaatsen van een Scope of Banner op de Website van H@W komt een overeenkomst tot stand tussen klanten enerzijds en H@W anderzijds. Daarbij gelden de tarieven en overige bepalingen en gedragsregels zoals weergegeven op de Website in het helpcentrum, alsmede deze algemene voorwaarden. Commerciële plaatsing op de Website vindt plaats gedurende een door H@W te bepalen aantal dagen. 3.2 Door het aanbieden van een Scope of Banner geeft de klant H@W toestemming de ingesloten informatie, inclusief eventueel foto- en videomateriaal te (doen) plaatsen op de Website. 3.3 H@W spant zich naar redelijkheid in te bewerkstelligen dat de Klant reacties op zijn Scope of Banner krijgt. Zij doet dit door het beschikbaar stellen en zoveel mogelijk toegankelijk houden van de Website alsmede o.a. door zoekmachine optimalisatie en het aantrekkelijk houden en onder de aandacht brengen van de Website als geheel. H@W is uitdrukkelijk geen partij bij enige overeenkomst die als gevolg van het gebruik maken van de Website tot stand komt tussen Klant en Bezoekers. 3.4 Elke klant heeft, zonder enige kosten, de beschikking over ongelimiteerde aantallen Scopes, waarbinnen een X aantal files kunnen worden opgeslagen. I-scope behoudt zich het recht voorbehouden om limieten te stellen aan de opslagcapaciteiten. 3.5 Elke klant die zonder premium account zijn/haar scopes plaatst, kan binnen zijn scopes een reclameboodschap geplaatst krijgen. Ook worden er via verschillende andere pagina’s reclameboodschappen vertoond. 3.6 Alle advertenties worden ook vertoond in de embedded scopes/webshops, welke zonder premium account zijn gemaakt. Artikel 4. Zakelijk – particulier gebruik 4.1 H@W maakt onderscheidt tussen Particulieren en Zakelijke klanten. 4.2 In verband met de facturatie is het belangrijk om op te geven of uw Zakelijk of persoonlijk adverteert. 4.3 H@W is gerechtigd Scopes of Banners te blokkeren indien ter zake naar haar oordeel de opgave zakelijk/particulier niet correct is gedaan. 4.4 Zakelijke klanten krijgen bedragen exclusief btw doorberekend. 4.5 Particulieren worden bedragen inclusief btw doorbelast. 4.6 H@W staat toe dat haar platform gebruikt wordt door particulieren en bedrijven, waarbij het iedereen vrij is om i-Scope te gebruiken als CMS (Control Management Systeem) 4.7 H@W Staat toe dat haar players kunnen worden geëxporteerd naar en in andere websites, webpagina’s, webblogs en sociale media. 4.8 H@W staat toe dat iedereen een webshop kan maken en een Seller kan worden 4.9 H@W staat toe dat iedereen een webshop kan plaatsen in een groep en deze groep kan exporteren naar en in andere websites, webpagina’s, weblog en sociale media. Hierdoor wordt diegene een Reseller en ontvangt hij/zij een provisie over verkochte, betaalde en geleverde goederen, van de eigenaar van de ingebouwde webshop. 4.10 Seller kan individueel Resellers uitsluiten en zijn webshop uit een bepaalde groep halen. Reseller verliest zijn rechten vanaf de datum van beëindiging Artikel 5 Abonnement – Premium account 5.1 Indien je geen reclames in je Scopes/Webshops wilt zien, dan kun je dit afkopen. Het bedrag is afhankelijk van het aantal Scopes die jij zonder reclame wilt presenteren en is een jaarlijkse bijdrage. (prijslijst beschikbaar in help en op profiel pagina onder ‘Upgrade’) 5.2 H@W is gerechtigd prijzen aan te passen. Deze prijswijzigingen kunnen uitsluitend betrekking hebben op nieuw af te sluiten abonnementen. 5.3 H@W kan bepalen dat andere en/of nieuwe te ontwikkelen services ook tegen betaling moeten worden afgenomen. Artikel 6. Content. 6.1 De Klant draagt er zorg voor dat de omschrijving van een aangeboden product of dienst overeenkomt met de werkelijkheid en derhalve juist en volledig is. 6.2 De klant is gerechtigd tot het plaatsen van zijn foto- en videomateriaal, muziekbestanden en teksten. 6.3 Ook voor het overige dient de inhoud van de Scope te voldoen aan de regels voor de inhoud van publicaties zoals weergegeven op de Website, waarvan de inhoud als hier herhaald en ingelast wordt beschouwd. 6.4 H@W behoudt zich het recht voor om zonder opgave van redenen Scopes/webshops voortijdig te verwijderen uit de publieke publicatie en terug te plaatsen naar privé toegang. De Klant zal in geen van de in dit lid bedoelde gevallen recht hebben op restitutie of enige vorm van schadevergoeding. 6.5 Indien in de Scopes/webshops een product wordt aangeboden, dient tegelijk met het aanbieden van het product op de Website door de Adverteerder een minimumprijs te worden aangegeven waarvoor het product kan worden gekocht. Zonder minimumprijs kan het product niet worden aangeboden. 6.6 De Klant is verplicht om per omgaande zorg te dragen dat de Scope/webshop wordt verwijderd of aangepast zodra een daarin aangeboden product of dienst niet langer beschikbaar is. Hiermee wordt de website actueel gehouden. 6.7 Indien de klant een webshop aanmaakt, dienen de bankgegevens als extra informatie in het profiel worden aangemaakt. Artikel 7. Betaling/incasso. 7.1 Premium Accounts worden betaald via de betaalmodule in de website en zijn voor 1 jaar geldig. 7.2 Indien sprake is van extra betaalde content draagt H@W er zorg voor dat de Scope of Banner direct wordt geplaatst op de juiste pagina van de Website. De Adverteerder ontvangt een factuur per e-mail met een eenmalige machtiging of kan de factuur op verschillende wijze betalen, afhankelijk per land. 7.3 H@W is gerechtigd de Klant per direct uit te sluiten van gebruik van de Website indien de Klant in strijd handelt met de bedoelde betaalprocedure. 7.4 Indien betaling uitblijft en H@W genoodzaakt is ter inning van aan haar verschuldigde bedragen (rechtskundige) bijstand in te roepen, komen alle daarvoor gemaakte kosten, met een minimum van € 350,-, voor rekening van Klant. 7.5 Ontvangen betalingen worden door H@W niet gerestitueerd. Wel kunnen betalingen onder omstandigheden (ter beoordeling door H@W) worden toebedeeld aan het tegoed van Adverteerder. 7.6 Alle transacties uit webshops worden via de betaalmodule van i-Scope geïncasseerd. De ontvangen bedragen worden aan Seller/Reseller uitgekeerd -/- 5% provisie + de kosten van de bank overboeking. 7.7 Eindgebruikers die goederen hebben besteld en betaald via de i-Scope betaalmodule en deze annuleren door levertijd overschrijding van Seller met ten minste 120 dagen, krijgt van i-Scope zijn betaalde bedrag teruggestort -/- 5 % i-Scope provisie + kosten van de bankoverboeking. 7.8 Resellers ontvangen een provisie van ten minste 5% over de betaalde- en geleverde goederen die zijn verkocht via de embedded webshops die door Reseller zijn geïnitieerd. Artikel 8. Vrijwaring. 8.1 De Klant draagt er zorg voor dat de Scope en/of de in de Scope aangeboden mediabeelden, geluiden, producten, informatie en/of diensten geen inbreuk maken op rechten van derden, waaronder rechten van intellectuele eigendom, en dat deze geen wet en/of regelgeving schenden, niet aanstoot gevend, obsceen, beledigend, onjuist of misleidend zijn. 8.2 Adverteerder vrijwaart H@W tegen alle aanspraken van derden die gebaseerd zijn op het beweerdelijk niet voldaan zijn aan het sub 7.1 bepaalde. De Adverteerder is aansprakelijk voor alle kosten van verweer die ter zake door H@W moeten worden gemaakt. Artikel 9. Beperking van aansprakelijkheid. 9.1 H@W is niet aansprakelijk voor schade die direct of indirect voortvloeit uit het gebruik dat Klanten of Bezoekers van de Website maken. H@W is niet aansprakelijk voor gedragingen van Klanten of Bezoekers, voor de inhoud van Scopes/Webshops of voor de producten en diensten die worden aangeboden. 9.2 De informatie die door H@W zelf op de Website is geplaatst is met grote zorgvuldigheid samengesteld. Niettemin is H@W niet aansprakelijk voor daarin opgetreden onjuistheden of onvolledigheden. 9.3 De aansprakelijkheid van H@W voor haar verplichtingen op grond van de met de Klanten gesloten overeenkomst is voorts beperkt tot het bedrag dat de Adverteerder heeft betaald c.q. verschuldigd is voor de plaatsing van extra content t.b.v. de Scope of Banner. 9.4 Iedere aansprakelijkheid voor indirecte schade van Adverteerders of Gebruikers, waaronder begrepen gevolgschade, gederfde winst, gemiste besparingen, schade door bedrijfsstagnatie en schade door verlies van gegevens, is uitdrukkelijk uitgesloten. Artikel 10. Servicedesk. 10.1 H@W stelt aan Klanten of Bezoekers een Servicedesk ter beschikking, waar zij per e-mail terecht kunnen met vragen over en problemen met de plaatsing van Scopes. 10.2 De Servicedesk beantwoordt de gestelde vragen naar vermogen en naar beste kunnen. Adviezen worden echter opgevolgd op eigen risico. H@W is niet aansprakelijk voor eventuele schade die ontstaat als gevolg van door de Servicedesk verstrekte adviezen. Artikel 11. Gebruik van persoonsgegevens. 11.1 Indien gebruik wordt gemaakt van de Website, dienen de gegevens waaronder, doch niet beperkt tot, naam/adres/woonplaats, e-mailadres, volledig, juist en actueel te zijn. Gebruiker garandeert wettelijk bevoegd te zijn om op enige wijze gebruik te maken van de Website. 11.2 De verantwoordelijke voor de gegevensverwerking is Home at World BV te Almere. 11.3 Persoonsgegevens zullen uitsluitend aan derden worden verstrekt binnen de hier beschreven voorwaarden, wanneer hiervoor een technische noodzaak is en om te voldoen aan een verzoek van opsporingsambtenaren en/of instanties die zijn belast met rechtshandhaving in het kader van het tegengaan van misbruik van de Website. In laatstgenoemd geval kunnen ook gegevens omtrent IP adressen beschikbaar worden gesteld. 11.4 Op de Website worden algemene bezoekgegevens bijgehouden. Het doel hiervan is om de inrichting van de Website te optimaliseren. 11.5 Cookies zijn kleine stukjes informatie (bestandjes) die een website op uw computer achterlaat. H@W gebruikt cookies om het navigeren in de Website te vergemakkelijken, om het gebruik van de Website te kunnen analyseren en om daarmee de Website te kunnen optimaliseren. Ook kunnen deze gegevens worden gebruikt om meer gerichte informatie op de site te zetten. Cookies worden tevens gebruikt om informatie te verzamelen over klanten, voor doeleinden van gerichte communicatie, waaronder het verstrekken van service-informatie rond onze producten en gerichte marketingactiviteiten rond de producten van H@W. Derden zijn uitgesloten. De verwerking van cookies vindt deels plaats door derden. Deze derden hebben echter geen toegang tot persoonlijke gegevens. 11.6 Het is Klanten of Bezoekers alleen toegestaan gebruik te maken van via de Website verkregen (persoons)gegevens met het oog op het sluiten van een mogelijke overeenkomst. Gebruik voor enig ander doel is verboden, waaronder het verzenden van (ongevraagde) e-mail(s) waarvan de inhoud niet direct betrekking heeft op de inhoud van de Scope, zulks ongeacht of het boodschappen betreft van commerciële aard; het verzamelen van e-mailadressen van Klanten of Bezoekers Artikel 12. Beveiliging. 12.1 H@W spant zich naar redelijkheid in haar systemen te beveiligen tegen verlies en/of tegen enige vorm van onrechtmatig gebruik en legt hiervoor passende technische en organisatorische maatregelen ten uitvoer, waarbij onder meer rekening wordt gehouden met de stand van de techniek. 12.2 H@W is echter niet aansprakelijk voor verlies van gegevens, schade aan bestanden, onrechtmatig verkregen toegang tot computers of bestanden, via Scopes verspreide virussen of andere onrechtmatige programma’s of bestanden, of enig ander gevolg van het gebruik dat van de Website wordt gemaakt. Artikel 13. Sites en diensten van derden. 13.1 De Website en Scopes kunnen verwijzingen bevatten (bijvoorbeeld door middel van een hyperlink, banner of button) naar Scopes van derden binnen de site van H@W en naar andere websites H@W linkt bedrijven door naar andere URL’s of websites. 13.2 Indien en voor zover gebruik wordt gemaakt van diensten van externe dienstverleners, waaronder begrepen Ideal , creditkaart maatschappijen, Sms diensten of telefoon providers, zijn de voorwaarden en privacyregels van deze dienstverleners van toepassing. H@W is niet verantwoordelijk voor de rechtshandelingen c.q. het beleid van deze dienstverleners. Artikel 14. Feedback. 14.1 Gebruikers van de Website worden in de gelegenheid gesteld om op de Website feedback te geven en kunnen bij een profiel commentaar geven. 14.2 Bij misbruik of onrechtmatig handelen (onder meer beledigende taal) door Klanten of Bezoekers met betrekking tot het geven van feedback kan H@W de toegang van de betrokkene tot de Website blokkeren en zijn/haar profiel verwijderen. Artikel 15. Gebruikers en geregistreerd gebruikers 15.1 Bezoekers hebben de mogelijkheid zich op de Website te registreren. Zij kunnen dan contact leggen met scope eigenaren en inloggen met een eigen gebruikersnaam en wachtwoord. 15.2 Het leggen van contacten met Klanten(s) via de Website geschiedt vrijblijvend en dient als een mogelijkheid om tot elkaar te komen. Het uiteindelijk tot stand komen van een Overeenkomst vindt plaats in direct contact tussen Klant en Gebruiker. H@W is daarbij op geen enkele wijze partij. Artikel 16. Uitsluiting. 16.1 H@W behoudt zich het recht voor om Klanten of Bezoekers uit te sluiten van elk gebruik van de Website indien op enigerlei wijze in strijd wordt gehandeld met de wet, de openbare orde, de goede zeden en/of de onderhavige algemene voorwaarden. 16.2 Bedoelde uitsluiting geschiedt onverminderd het recht van H@W om rechtsmaatregelen te nemen en/of schadevergoeding te vorderen. Artikel 17. Intellectuele eigendom. 17.1 Alle intellectuele eigendomsrechten met betrekking tot de Website, waaronder begrepen de teksten, afbeeldingen, vormgeving, foto´s , beeld- en/of geluidsmateriaal, formats, software, merken en domeinnamen, berusten bij H@W respectievelijk haar licentiegevers. 17.2 Het is Klanten of Bezoekers verboden om de Website of enig gedeelte daarvan te verveelvoudigen dan wel ter beschikking te stellen (middels deeplinken of anderszins) zonder toestemming van H@W. Artikel 18. Slotbepalingen. 18.1 Nietigheid van enige bepaling van deze algemene voorwaarden zal geen effect hebben op de bindendheid van de overige bepalingen. 18.2 Op de algemene voorwaarden is Nederlands recht van toepassing. Alle uit deze overeenkomst voortvloeiende geschillen die niet in goed onderling overleg tot een oplossing kunnen worden gebracht zullen worden voorgelegd aan de bevoegde rechter te Amsterdam. 18.3 Deze algemene voorwaarden kunnen door H@W worden gewijzigd. De gewijzigde voorwaarden zijn direct beschikbaar op de Website. Article 2. Usability. 2.1 The General Conditions are applicable to the respective relationships between Advertisers and Users, and i-Scope on the other hand. 2.2 There are no other general conditions applicable, except for those stated here. Conditions of Sellers and Resellers is an adjustment. Article 3. Placement of Advertisements. 3.1 A contract between the Advertiser and i-Scope comes about by placing a scope on the website. The tariffs, other conditions and codes of conduct, are applicable as found on the website, including these General Conditions. 3.2 By offering a Scope for placement the Advertiser gives i-Scope permission to place the Scope information in the advert on the website, including any enclosed photo and video material. 3.3 i-Scope will expert all reasonable effort to ensure that the Advertiser receives reactions to his advert. This is through making the website as widely available as possible, by making Categories available, by keeping the website attractive to viewers through the use of the best updates, and by ensuring that the website stays in peoples’ attention in general. i-Scope is notably not a party to any contract which an Advertiser and User may enter into from contact via the website. 3.4 Every user, can upload Unlimited quantities of Scopes/Web shops, within also Unlimited quantity of files. However i-Scope will keep the rights to limit to store the amount of data. 3.5 Every user without a premium account will see ads in his/her Scopes/Web-shops. We can also place ads in other pages in users profile. 3.6 Ads are also shown in the embedded players, which are made without premium account. Article 4. Business / Private Person use. 4.1 i-Scope is distinguished between private and business customers. 4.2 In connection with the billing, it is important to specify whether your business or personal advertising 4.3 According to its own judgement, i-Scope reserves the right to block immediately, or remove the placement of any Scope/Web-shops where the Business /or Private Person details are not correctly. 4.4 All amounts for premium accounts are excl. VAT for company enterprises. 4.5 All amounts for premium accounts are incl. VAT for private individuals. 4.6 The i-Scope platform is used by individuals and companies, everyone is free to use i-Scope as CMS (Control Management System) 4.7 The I-Scope multimedia players/web-shops can be exported to other web sites, web pages, web logs and social media. 4.8 I-Scope allows to all users to make web-shops and became a Seller. 4.9 I-Scope allows that users make their own group of web-shops, consisting web-shops from other Sellers. These groups can be embedded in other websites, web pages, weblogs or social media. These users will be Resellers and received from Seller a commission on the paid and delivered sales, coming out of Resellers group. 4.10Seller may exclude individual resellers and shop from a certain group here. Reseller will lose his rights from the date of termination Artikel 5 Subscription– Premium account 5.1 If you don’t wanted to see any ads in your Scopes/Web-shops you can buy a premium account. The amount depends on the quantity of Scopes/Web-shops you like to present without ads. The amount you pay is a yearly fee. 5.2 i-Scope is authorized to change her prices. These prices are valid only for new subscriptions. 5.3 i-Scope can decide to change their business model and make other- and new services only available for premium account holders. Article 6. Content. 6.1 The Customer shall ensure that the description of a product or service offered corresponds to reality and therefore is correct and complete. 6.2 The User has the right to place photo and/or video material or text. 6.3 The information in the Scope must be in line with the rules of publication as published on the website in Help centre. The text is herewith implemented and repeated. 6.4 i-Scope reserves the right, without giving reasons Scopes / webshops prematurely removed from the public and put it back to private access. The Customer shall not in any of the cases referred to in this paragraph entitled to a refund or any form of compensation. 6.5 If user offered a product, than user should mention a minimum price. Otherwise we can not place the article 6.6 The user has the obligation to delete or change the Article from his Web-shop, if the published product is not longer available. 6.7 If User creates a Web-shop, i-Scope will ask user the bank details and additional information to create in user’s the profile. This information is secured only for internal use. Article 7. Payment/ (Debt) Collection. 7.1 Premium accounts are paid through the payment module in the website and are valid for one year. 7.2 Where extra paid content is applicable i-Scope will ensure that the scope/advert is placed directly higher in the hit list on the website. The Advertiser will receive an invoice by e-mail with a direct debit or invoice may be paid differently, depending on each country. 7.3 i-Scope is authorised to exclude an Advertiser from further use of the Website if they act in a way that is contrary to the intended payment procedure. 7.4 If payment (from the Advertiser to i-Scope) is not forthcoming and i-Scope is necessitated to take measures to retrieve payments owed to it, or seek legal assistance, then all costs resulting from such procedures will be charged to the Advertiser with a minimum of € 350.00 7.5 Received payments will not be refunded by i-Scope. At the discretion of i-Scope, in certain circumstances, payments may be added to the credit of the Advertiser. 7.6 All transactions through online Web-shops will collect from the payment module of i-Scope. The amounts we received in your name and transfer it to Seller / Reseller - / - 2% commission + the cost of the bank transfer. 7.7 End users whom ordered products from Seller and paid them via the i-Scope payment module and cancel the delivery because Seller exceeded delivery time with at least 120 days, will be refunded - / - 2% i-Scope fee + cost of bank transfer. 7.8 Resellers receive a commission of at least 5% of the paid and delivered goods, sold through the embedded web shops that are initiated by Reseller. Article 8. Indemnification. 8.1 The User will ensure that the Web-shop itself and/or the products/services included in the Web-shop do not infringe on the privacy of others, including intellectual ownership rights; and that they do not go against any law and/or ruling, that they are not offensive, obscene, insulting, incorrect or misleading in any way. 8.2 It is the responsibility of the User to safeguard i-Scope against any/and all claims from third parties based on any assertions arising from article 11.3. The Advertiser is liable for all legal defence costs which i-Scope incurs in this regard. Article 9. Restricted liability. 9.1 i-Scope is not liable for damages incurred directly or indirectly from the use of customers or visitors to the Website. H @ W is not liable for conduct of Customers or Visitors for the content of Scopes / or Web shops for the products and services offered. 9.2 The information provided by H @ W itself on the Website is loaded with great care. Nevertheless, H @ W is not liable for any errors therein or omissions occurred. 9.3 The liability of i-Scope for her responsibilities based on the agreements made with the Advertiser is further restricted solely to the amount that the Advertiser has paid/ is charged, for the placement of extra content in connection with the Advertisement. 9.4 Any liability for consequential damages of Advertisers or Users, including consequential damages, lost profits, lost savings, damage and business interruption damages for loss of data, is expressly excluded. Article 10. Email Service desk. 10.1 For its Advertisers and Users i-Scope has provides a Service desk where questions can be asked via Email about the placement of scopes/web-shops. 10.2 The Service desk will answer the questions to the best of their knowledge and ability. However, the use of any advice is at the user´s discretion. i-Scope cannot be held responsible for possible damage arising as a result of advice given by the Service desk. Article 11. Use of personal information. 11.1 If use is made of the website, information including (though not solely) name/ address/ postal code/ city/ Email address, must be correct and up-to-date. The User guarantees to be legally qualified to use the website in any way. 11.2 H@W BV / i-Scope in Almere (NL) is responsible for the information data processing. 11.3 A User’s personal information will only be passed on to third parties within the strict guidelines of our privacy policy, when there is a technical necessity for this, or to comply with a formal request for information from an official investigative civil servant and/or agencies who are responsible for law enforcement concerning website misuse. Security. 12.1 i-Scope does everything within reason to guard against loss, or any form of unauthorized use/access and organizes suitable technical and organizational measures whereby, amongst other things, the present state of the technology is accommodated for. 12.2 However, i-Scope is not responsible for any loss of personal information, damage to files, unlawful access to computers or files, Advertisement-spread viruses, or other unlawful programmes or files, or any other consequence arising from improper use of the website. Article 13. Third party sites and services. 13.1 The i-Scope website and Advertisements may contain certain references (e.g. via the use of a hyperlink, banner, or button) to the Spaces of third parties, i-Scope will link through to other URL’s, or to other websites. 13.2 If, and in so far as, use is made of the services of external service providers (including Ideal, credit-card companies, SMS services or telephone companies, then the general and privacy conditions of these service providers are applicable. i-Scope is not liable for the legal supervision, or policy of these service providers. Feedback. 14.1 Users of i-Scope.com are able to give feedback concerning the course of the contract they have with an Advertiser. 14.2 Where a User misuses this service, or acts unlawfully (including using abusive language) when giving feedback, then i-Scope may block the User from access to the Website. Article 15. Registered User (RU) 15.1 Users, or Buyers, may choose to register themselves on i-Scope.com . In this way they can then make direct contact with Seller and Reseller and Log in with their own User name and password. 15.2 Making contact with Seller on the i-Scope website is voluntary and serves to facilitate easy, quick, effective communication between both parties. The eventual resultant Agreement is made directly between the Advertiser and the RU. i-Scope is not party to this Agreement and plays no further role in the negotiations whatsoever. Article 16. Exclusions. 16.1 i-Scope reserves the right to exclude any Advertiser and/or User/Buyer from using the website if in any way National Laws, Public Order, Common Decency, and/or the i-Scope General Conditions are broken. 16.2 Such exclusion shall prejudice the right of H @ W to legal measures and / or damages. Article 17. Intellectual Property. 17.1 All intellectual property rights concerning the i-Scope Website; implicitly including all texts, images, design, photo’s, picture and/or sound material, formats, software, brands and domain names, are the exclusive property of i-Scope and her licensees. 17.2 Advertisers and/or Users/Buyers are explicitly forbidden to duplicate and/or copy the Website, or parts of it, or to make anything available in any other form, without express permission from i-Scope. Final Conditions. 18.1 Invalidity of any provision of these terms will not affect the binding of the remaining provisions. 18.2 The General Conditions are primarily subject to the Civil Laws of The Netherlands. Definitions. Web-shop: Web-shop consisting of one or multiple scopes, which included an order and payment module. Group Scope: Scopes or web-shops in a group included. Seller: Companies or persons who create 1 or several web-shops. Reseller: Companies or persons whom embedded an i-Scope web-shop from Sellers into their own websites, web-pages, weblogs or social media. Commission: A percentage of sales. Embed: Installation or export of the i-Scope flash players in other websites or social media. Scope: a set of files (pictures, videos, music and music) Article 2. Applicability. 2.1 These general conditions apply to the relationship between customers and H @ W. 2.2 These terms and conditions for Sellers and Resellers is part of the General Conditions of i-Scope.com Article 3. Web-shops 3.1 By placing a Web-shop on the Website of H @ W is an agreement between Seller and H @ W other. Article 4. Business - private use 4.1 H @ W is distinguished between private and business customers. 4.2 In connection with the billing, it is important to give your business or personal advertising. 4.3 W @ H is entitled to block Web-shops relevant it considers the assignment business / private is done incorrectly. 4.4 Business customers receive amounts excluding VAT. 4.5 Individuals will be charged for amounts including VAT. 4.6 W @ H allow that the platform i-Scope.com is used by individuals and companies, where everyone is free to use i-Scope as CMS (Control Management System) 4.7 W @ H allow her media players to be exported to other Web sites, Web pages, Web logs and social media. 4.8 W @ H allow that everyone can make a Web-shop and become a Seller. 4.9 W @ H allow everyone to embed a Web-shop in a group and this group and can export to other web sites, Web pages, blogs and social media. (Price list available to help and profile page under "Upgrade") 5.2 W @ H is entitled to adjust prices. This price changes may relate only to new subscriptions. 5.3 W @ H is allowed to charge for other services or for new developments services. Article 6. Content. 6.1 The Seller shall ensure that the description of a product or service offered corresponds to reality and therefore correct and complete. 6.2 The Seller is entitled to place his photo and video, music and text files. 6.3 The Seller may administrate a list of articles and linking individual Articles to images (6.2) 6.4 For the remainder of the contents of the Scope to comply with the rules for the content of publications such as displayed on the Site, the content of which are repeated here and inserted considered. 6.5 H @ W reserves the right to change without notice a Scopes / webshops prematurely removed from publication and remove it to to private modus. Payment / collection. 7.1 W @ H is entitled to close Seller / Reseller immediately of using of the Website, if they violate the agreed rules of payment. 7.2 All transactions are collected through the payment module from i-Scope.. The amounts received will be paid to Seller / Reseller - / - 2% commission + the cost of the bank transfer. Disbursements will take place after Transport / tracking numbers are known. 7.3 End users who have ordered goods and paid through i-Scope payment module and cancel delivery if Seller exceeded by at least 120 days, will be refunded - / - 2% i-Scope + cost of the bank transfer. 7.4 Resellers receive a commission from Sellers at least 5% of the paid and delivered goods sold through the embedded web shops which Reseller initiated. Commissions less than € 50, - are converted into a credit and be paid after the € 50, - is reached. Article 8. Indemnification. 8.1 The Seller shall ensure that the web shop and / or the Scope of the offered media images, sounds, products, information and / or services do not infringe the rights of third parties, including intellectual property rights, and that no law or regulation violation, does not offend giving, obscene, offensive, inaccurate or misleading information. 8.2 Seller shall indemnify H @ W against all claims by third parties based on the allegedly met with theunder 7.1 and certain other allegations. The Seller is liable for all costs of defending such matters by H @ W should be made. 8.3 The Seller shall indemnify its customers for cancellation by late delivery by Seller. 8.4 The customer indemnifies H @ W for all claims from third parties.
